Terms & Conditions
Auction Auto Shippers is a division of NX, LLC (“Broker,” “we,” “us,” or “our”). By placing an order with us, you (“Customer”) agree to the following Terms & Conditions.
1) Parties & Definitions
- Customer: The person or entity listed in shipping or billing, including cardholder.
- Dealer: Customer acting on behalf of a dealership (owner, manager, sales staff, etc.).
- Carrier: The motor carrier we assign to transport your vehicle(s).
- Dispatch / Assignment: When we assign a Carrier to your order; special cases (e.g., export/offshore) may have dispatch defined as vessel booking or terminal release.
2) Transparent Pricing, Quotes & Deposits
- All-In Quotes: Quotes from us include known fees and surcharges. We list winch/forklift, in-operable, access, residential / gate fees if applicable. There are no hidden fees.
- Booking & Deposit: Free to request. No deposit is required until Dispatch / Carrier assignment, except where required for port, vessel, or specialty reservations.
- Price Lock Guarantee: The price in your quote is locked once a Carrier is assigned under the disclosed vehicle condition. If any third party demands additional fees due to misrepresentation or omitted details, you must inform us immediately.
3) Payments & Accepted Methods
- Deposit at Dispatch: We charge our service deposit when a Carrier is assigned. This deposit is non-refundable once assigned.
- Final Balance: Due upon delivery in certified funds (cash, cashier’s check, money order) unless other arrangements are agreed.
- Credit Card Option: Available upon request. For full-credit card payment convenience, fees may apply depending on the total amount.
- Operational Exceptions: Some short-haul runs or special cases (heavy modifications, remote locations) may require partial payment or full payment at Dispatch; we will notify you if that applies.
4) Communications & Opt-Out
- By placing an order, you consent to be contacted via phone, email, and SMS for service updates. Carrier message rates may apply.
- For marketing or promotional communications, you may opt out by replying “UNSUBSCRIBE” or following opt-out instructions. Doing so may limit non-essential notifications, but not critical updates like pickup/delivery info.
5) Scheduling, Availability Window & Delays
- Dispatch Window: After you provide all required information, it may take up to 10 calendar days to assign a Carrier, depending on lane demand.
- Cancellation before Dispatch: You may cancel anytime before a Carrier is assigned with no penalty.
- Estimated Timing: Pickup & delivery dates are estimates. Delays may result from yard policies, weather, mechanical issues, traffic, or other carriers’ schedules.
- Dry-Run Fee: If your vehicle is not released or ready when the driver arrives, a dry-run fee (e.g. $100) may apply.
6) Vehicle Condition, Size/Weight & Loadability
- Operability Disclosure: Vehicles are assumed to be operable (run/steer/brake) unless you disclose otherwise. If you misrepresent, additional fees may apply.
- Modifications / Oversize: Non-standard vehicles (lift kits, modified tires, oversize accessories) must be disclosed in advance. Failure to do so may lead to additional charges or refusal of service.
7) Pickup / Delivery, Door-to-Door & Access Limits
- Door-to-Door Defined: We will attempt pickup and delivery at the provided addresses. If physical or safety constraints (narrow roads, low clearance, restricted access) prevent exact delivery, you agree to meet at the nearest safe and legal location.
- Contact Requirement: You must provide accurate contact information for pickup and delivery locations, and ensure someone is present (or authorized) to release or accept the vehicle and complete necessary documents.
8) Bills of Lading (BOL), Inspections & Claims
- Inspection Required: At both pickup and delivery, the Carrier (or your representative) and you should inspect the vehicle’s exterior and record condition on the Bill of Lading (BOL).
- Signed BOL: A signed BOL is required for any damage claim. Without it, claims may be denied. Photos/videos are helpful but not sufficient on their own.
- Timing for Claims: If new damage is observed, you must note it on the delivery BOL and report it to the Carrier (and to Auction Auto Shippers) within 3 business days.
9) Insurance & Risk Allocation
- Carrier Insurance: While in transit, your vehicle is covered by the assigned Carrier’s cargo insurance (limits and deductibles apply). We do not insure damage outside the scope of the Carrier’s policy.
- Personal Property: Items inside the vehicle (personal belongings, household goods) are not covered by insurance and may be refused during transport.
10) Ports, Export, & Special Territories
- For any shipments involving port drop-offs, exports, or remote/offshore territories (e.g., Hawaii, Alaska, Puerto Rico), special rules, vessel fees, or limitations may apply.
- You are responsible for complying with export/terminal requirements and providing any required documents.
11) Role of Auction Auto Shippers; Carrier Identity
- Broker Role: Auction Auto Shippers is a broker arranging carriage. We are not the actual motor Carrier. The Carrier we name in dispatch is the party responsible for transport.
- You agree to release the vehicle only to the named Carrier. If a driver or representative arrives under a different name, contact us before release.
12) Payment Timing, Non-Payment & Billing Issues
- If payment instruments fail or you are unreachable after Carrier assignment, we may still proceed with dispatch to maintain scheduling. In such cases, additional fees (processing, storage, etc.) may apply.
- If full balance is not available at delivery, the Carrier may hold the vehicle until paid; storage or holding fees may accrue.
13) Cancellations, Refunds & Processing
- Before Dispatch: Cancel at any time prior to Carrier assignment without fee.
- After Dispatch: Once a Carrier is assigned, the deposit becomes non-refundable and serves as a cancellation fee.
- Refunds: If full payment was collected and you cancel after dispatch, we refund any portion not already earned by Auction Auto Shippers or the Carrier (minus any non-refundable deposit or convenience fees). Refunds generally process in 7-10 business days.
14) Double-Booking & Conflicting Orders
- You agree not to hire another broker or Carrier for the same vehicle(s) once Auction Auto Shippers has dispatched a Carrier.
- If you double-book and someone else picks up first, it’s treated as a cancellation after dispatch, and the deposit remains non-refundable.
15) Dealers — Authority & Liability
- If you represent a dealership, you warrant you have full authority to arrange transport.
- If invoices go unpaid, both the signing Customer and the dealership may be held responsible.
16) Prohibited Items & Inside Vehicle Policies
- You may not have firearms, ammunition, explosives, flammables, illicit substances, illegal items, pets (unless approved), cash, jewelry, or high-value electronics inside the vehicle. Such items are not covered by insurance.
- Carriers are not responsible for damage or loss of personal items left inside vehicles.
17) Governing Law & Venue
These Terms are governed by the laws of the State of Florida. Any legal action or proceeding must be brought in the courts located in Broward County, Florida, and you consent to the jurisdiction thereof.
18) Defense, Indemnity & Hold Harmless
You agree to defend, indemnify, and hold harmless Auction Auto Shippers, NX, LLC, its officers, employees, agents, and contractors from any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of your misrepresentations, breach of these Terms, or any acts or omissions connected to the transport request.
19) Severability, Entire Agreement & Modifications
- If any provision of these Terms is invalid, illegal, or unenforceable, the other provisions remain in full effect.
- These Terms constitute the entire agreement between you and Auction Auto Shippers concerning transport services. Any prior agreements or understandings are superseded.
- No modification is valid unless in writing and signed by you and an authorized officer of Auction Auto Shippers.
20) Customer Acknowledgment
By placing an order, you represent that you are either the legal owner of the vehicle(s) or authorized by the legal owner to contract for transport. You authorize Auction Auto Shippers to arrange Carrier transportation as per these Terms & Conditions.
